Terms of Service

Last updated: October 28, 2026

These terms apply when you ask Cellar Haul for a pickup or delivery, whether through the request form on cellarhaul.com or by email. If you have signed a separate agreement with us, that agreement controls where it differs from this page. Questions? Email [email protected].

Who we are

Cellar Haul is a truck delivery and errand service in and into downtown San Francisco, for restaurants and local businesses. Our deliveries are made by Cellar Haul's driver. We work with business clients (B2B).

We transport goods. That is all we do.

We do not buy, sell, resell, broker, take orders for or take ownership of any goods, including alcohol. We do not handle payment for your goods. Our fee is for transport only, and our charges are never payment for the goods. Nothing we say or write, including on a receipt, quote or message, is an offer to sell goods.

Requests, quotes and bookings

  • The website form is a request, not a booking. Sending a request does not hold a time and does not create a booking.
  • Every job gets a quote, and every trip is confirmed one by one, in writing. After we approve your quote, we email you a payment link for that amount. A trip is booked only when we have received your payment through that link (see "Payment and receipts" and "Your payment agreement" below). Until then it is a request, and a request that is not confirmed and paid carries no cancellation fee. If two requests ask for the same window, the first one paid gets it. We may decline a request, for example if we are full or the trip can't be done safely or lawfully.
  • Slots are one hour. You can request one or more 1-hour slots, in Pacific time, up to 30 days ahead.
  • Same-day bookings are allowed whenever a slot is available, and are confirmed one by one in writing. There is no extra fee for same-day.
  • Premier and after-hours service is available on request. Any premier or after-hours charge is shown as its own line on your quote and applies only when it is written on our confirmation.

Declared value and our responsibility for your goods

  • Declared value is required. Before each trip, you must list the items to be moved and tell us the accurate declared value of each line and a total for the trip. The declared value is your good-faith figure for what it would cost you to replace the items (your own cost, not a resale or retail price). We cannot confirm a trip until the declared value is stated.
  • We may accept or decline a trip based on its declared value, at Cellar Haul's discretion. There is no set value limit. For higher-value goods we may decline the trip, or ask for a higher-value arrangement (for example extra handling steps, a different time, or an added charge shown on your quote) that we agree to in writing before pickup. If we decline a trip because of its declared value, no charge applies.
  • Our limit of liability. From the time our driver signs for the goods at pickup until the recipient signs for them at delivery, Cellar Haul is responsible for loss of or damage to the goods caused by Cellar Haul's negligence. Our liability is limited to the lesser of the actual replacement cost of the lost or damaged items to you and the declared value of those items, and never more than the accurately declared total value for that trip as accepted by us in writing. We are not responsible for goods, or any part of their value, that were not declared or were under-declared.
  • We are not responsible for: loss or damage caused by your packing, labeling or instructions (including inadequate packaging or open or already-damaged containers); events outside our control (for example crashes caused by others, theft despite reasonable care, road closures, extreme weather, or acts of authorities); delay, or your lost sales, lost profits, event costs or any other indirect or consequential loss; goods released to a person you named or who appears authorized at the delivery address; temperature changes, unless temperature handling was confirmed in writing for that trip; or goods you have no right to ship.
  • This page does not limit any liability that the law does not allow to be limited.

Packing, your right to ship, and what we do not do

  • You are responsible for packing, sealing and labeling your goods so they can be moved safely and identified: sturdy cases or boxes in good condition, closed and sealed; fragile items packed so they will not shift or break; each package labeled with your name, the delivery name and the delivery address or trip ID.
  • You must have the right to ship the goods. The goods must belong to you, or come from a seller or sending business that is entitled to release them, and must not be stolen, counterfeit, recalled or otherwise unlawful to move. The information you give us (names, addresses, items, quantities, declared values) must be accurate and complete. You are responsible for any claim, fine or loss that results from these statements being untrue.
  • We do not open or inspect goods. The driver counts packages and notes their outside condition only. We never open or sample goods.
  • We may refuse, stop or return a load if in our judgment it or the trip is unsafe, unlawful, unlabeled, unsealed, open, leaking or visibly damaged, if the goods or paperwork do not match your request, or if the pickup or delivery site is unsafe or can't be reached. If we do, the cancellation terms below may apply, and we return the goods to the sender the same day.
  • Someone must be there. Have a person authorized, and old enough, to hand over and to receive the goods at the booked times. Goods are not delivered to anyone under age 21 or to anyone visibly intoxicated.
  • Handoff record. At pickup and delivery the driver takes photos of the goods and packaging and asks for a signature. If no one is there to sign, the driver records the receiver's name and the time with the photo. We keep them as our record of the count and outside condition, and may use them to resolve questions and claims.

What we don't carry

We may refuse or stop any trip at any time. In particular, we don't carry:

  • hazardous or illegal items;
  • items that are oversize or too heavy for us to carry safely (larger loads are quoted at booking when we can take them);
  • anything that needs two people to lift;
  • installation or assembly (we move items, we don't set them up);
  • live animals;
  • cash or high-value valuables.

If we decline a request before we confirm it, no charge applies. If we refuse or stop a confirmed trip for any of these reasons, the cancellation terms below may apply, and we will tell you as soon as we can and return the goods to the sender the same day.

Goods condition and temperature

Standard trips use a shaded truck that is not temperature-controlled: there is no refrigeration or heating, and we cannot guarantee a set temperature. Heat- and cold-sensitive goods travel at your own risk as to temperature. A trip is temperature-controlled only if we confirm it in writing for that trip, after you tell us the required range and handling needs before the trip. Even then, temperature readings are a record, not a guarantee, and we do not guarantee a set temperature or shelf life. We may decline any job.

Same day only, no storage

Every trip is picked up and delivered on the same day. We never store or hold goods: no warehousing and no overnight storage. Goods stay with the driver from pickup to delivery.

If a delivery can't be completed because of you or the recipient (for example no one is there to receive it, the address is wrong or can't be reached, the delivery is refused, or the recipient's site is unsafe), we return the goods to the sender the same day, and we charge a $145 return trip fee: we email you a new payment link for it and a receipt once you pay (the quote is already paid, so it is not charged again); Cellar Haul may waive this fee at its discretion. We never charge this together with a cancellation or no-show fee for the same trip. If the delivery can't be completed for a reason on our side (for example we cancel, the driver is unavailable, weather, safety or vehicle problems, or our own lateness, error or damage), we refund in full, with no card processing fee deducted, the quote you paid for that trip to the same card, we start the refund promptly, and there is no return trip fee. Any new delivery attempt is a new request, priced and confirmed separately.

Delivery sign-off and reporting a problem

When the recipient, or anyone at the delivery address, signs the delivery receipt, the goods are accepted as delivered and Cellar Haul's duties for them end. If no one is there to sign, our photo and the receiver's name and the time we record are the proof of delivery. Visible damage or shortage must be written on the receipt before signing, or reported to us the same day at [email protected]. Any later issue is between the sender and the recipient businesses. Nothing here limits liability that the law does not allow to be limited.

Cancellations, changes and no-shows

  • No cancellation fee 48 hours or more before the start of your booked slot.
  • 24 to under 48 hours before: 50% of the quote, minimum $25.
  • Under 24 hours before: 50% of the quote, minimum $25.
  • A client who cancels late may rebook, subject to availability, but the fee still applies.
  • How a fee is taken. We take a cancellation or no-show fee at once, rounded down to the cent. Because the quote is paid when the booking is confirmed, we keep the fee from your payment and refund the rest to the same card, minus the card processing fee we paid on the payment. So when we keep a fee, the total cost to you is the fee plus the card processing fee, and both are taken from your refund; nothing more is charged to your card. If the rest is smaller than the card processing fee, nothing more is refunded and nothing is charged to your card. Your refund receipt shows both amounts.
  • Free cancellation. A cancellation 48 hours or more before the start of your booked slot has no cancellation fee. We refund your payment to the same card minus the card processing fee we paid on it (the actual fee only, shown on your refund receipt), with no other charge.
  • When the card processing fee is deducted. Only when you cancel before the booking starts, and on the rest we refund after we keep a cancellation or no-show fee. It is never more than the actual fee we paid, and never more than the amount left to refund.
  • When it is not deducted. When the reason is on Cellar Haul's side: we cancel, the driver is unavailable, weather, safety or vehicle problems, our own lateness, error or damage, a failed delivery we caused, or a charge made by mistake. We refund in full.
  • Unpaid payment link. If a payment link is not paid, the trip is not booked and no cancellation fee applies.

"The quote" is the full quote, including any premier or after-hours charge, and a fee is never more than the quote. Only one fee applies to a booking; fees are never added together.

Why there is a fee: We hold your slot for you and may turn away other bookings. The fee is our reasonable estimate of that loss. We may work with clients case by case (waive, reduce or reschedule), but no client has a right to that.

Hours are counted from when we receive your written cancellation (Pacific time) to the start of the first booked slot.

No-show. A no-show is when no one is there at the booked time to hand over the goods, after reasonable attempts to reach the contact. A no-show is always charged the under-24-hours amount, is never eligible for a reschedule waiver, and counts as one fee per booking. If no one is there to receive the goods, the failed-delivery charge above applies instead, never both. There is no waiting fee.

Second missed booking. A missed booking is a late cancellation under 24 hours before the booked slot or a no-show. On a second missed booking of any kind, at any time while you use our service (a first late cancellation whose fee we waived still counts), we may decline to reschedule and we may charge up to the full quote for that booking.

Pickup not ready. If a pickup is not ready, Cellar Haul may reschedule the trip or charge the cancellation fee at its discretion. There is no waiting fee.

Changes. A change to the date or start time of your slot is free when you ask 48 hours or more before the start of your booked slot and we have an open slot for the new time. Inside 48 hours, it is treated as a cancellation plus a new request: the cancellation fee applies once, and the new request is subject to our availability and written confirmation. There is no separate late-change fee.

If we cancel or change a trip. If Cellar Haul cancels, or the driver is unavailable, there is no fee, and we refund in full, with no card processing fee deducted, what you paid for a trip we could not do, including any premier fee, to the same card; we start the refund promptly. The driver may delay, reroute or stop a trip for safety, access problems or road closures; we will tell you as soon as we can, and no cancellation fee applies when we cause the change.

Payment and receipts

  • Payment is by card. After we approve your quote, we email you a payment link for that amount, and you pay the quoted price through it when you confirm the booking. A trip is booked once we have received your payment, and we email you a receipt for every payment and charge. If we confirm less than 2 hours before pickup, payment is still needed before we can book it. The payment is for transport service only, never for the goods.
  • The payment link opens a payment page run by Stripe, our payment processor, where you enter your card and tick the required terms box. We do not save your card or charge it later, and we do not see or store your full card number. Nothing is charged unless you pay through a payment link we email you.
  • If your payment does not go through (for example your card is declined), or the payment link stays unpaid, the trip is not booked and we won't do the pickup. We may release the slot, and no cancellation fee applies when we do so for that reason. No late charge applies.
  • To question a charge, email [email protected] within 10 days of the receipt date. We refund in full a charge made by mistake to the card used. This does not limit any right you have with your card issuer.
  • Refunds go to the card you used, and only to that card. We start them promptly. Refunds are reduced only by the card processing fee, as described in "Cancellations, changes and no-shows" above (a free cancellation, or the rest after we keep a cancellation or no-show fee); a refund for a reason on our side is always in full.
  • Extra time beyond the quoted time is charged at $145 per hour ($72.50 per half hour), billed in half-hour steps. We email you a new payment link for it, with a receipt once you pay. A fee under these terms stays owed until it is paid, and we may wait to confirm a new booking until it is.

Your payment agreement

When you pay through a payment link we email you, you agree to pay the amount shown on it, for that booking or fee only, and you agree to these terms. We do not save your card and we do not charge it later. Each payment is made through its own payment link.

The quoted price is paid through the payment link when you confirm the booking (if we confirm less than 2 hours before pickup, payment is still needed before we can book it). A fee under these terms that arises after pickup (return trip fee, extra time beyond the quoted time) is requested by a new payment link, never more than these terms state, once per event, and never on a schedule. A cancellation or no-show fee is kept from the payment you already made, as "Cancellations, changes and no-shows" says. The amounts are in that section and in "Payment and receipts" above. You also agree that, when a refund is due, we deduct the card processing fee as that section says. We email you a receipt with the reason for each payment.

Limits. A cancellation or no-show fee is never more than the quote, and only one applies to a booking. Fees are rounded down to the cent.

Privacy

Our Privacy Policy explains what we collect, how we use it and how long we keep it. We keep delivery photos and booking records for 24 months.

Changes to these terms

We may update these terms by posting a new version here with a new "Last updated" date. If you have a signed recurring client agreement, the notice rules in that agreement apply to changes.
